Update on Noida Scheme 2004 Plots Draw Fraud By Noida AuthorityBy djain128, Section Gurgaon Real Estate Property Court Orders CBI to probe Noida land draw bungling and orders fresh draw with in one month. The Allahabad High Court has ordered a CBI probe into the bungling in Noida Authority's residential draw of plots held on July 2 through which some 1250 plots were allotted. The high court has also indicted the UP Government, UPDESCO and the Noida Authority for connivance in the draw. The high court Bench, comprising Mr Justice B. S. Chauhan and Mr Justice Dilip Gupta, hearing petitions filed by one of the allottees, Deepak Sharma, and an NGO, Manav Seva Samiti, ordered the CBI to probe the matter and submit its report to the high court within three months. The high court also ordered a fresh manual draw to be held within a month by the Noida Authority under the supervision of a two-member committee comprising the Secretary Agriculture, UP, and the Vice-Chairman of the Benares Development Authority. The high court had asked the Noida Authority and UPDESCO if the list of applications was scrutinised before the draw. For want of a clear answer by the respondents, the Noida Authority was ordered to screen the applications and categorise them into eligible and ineligible lots. The new lists after screening were accordingly submitted by the Noida Authority. The Income Tax department authorities had, meanwhile, complained UPDESCO had failed to give the software used in the draw in spite of repeated requests. Some glaring defects in 1.77 lakh applications for bigger residential plots had also been noted. Some plots had been allotted to minors who are ineligible and husband-wife duos. VIPs and senior IAS, IPS officers and their relations had all figured in the allottees. The manipulation in the draw had certainly been there, said an IT officer because some persons had been allotted as many as four plots. The high court said in its order the UP Government, UPDESCO and Noida Authority had connived against the public in this draw. Source The Tribune Friday's dt 23-9-05 hearing on Noida's countermanded draw of lots for plots may have been adjourned till Tuesday, but the main issue before the Allahabad High Court, is whether the draw should be scrapped altogether or held again with the ``defective'' list of applicants rectified. Both sides have several litigants as supporters. Meanwhile, income-tax officials say that Uttar Pradesh government agency UPDESCO, which had conducted the computerised draw of July 2, has ``still not given us the software used, despite repeated requests. There has definitely been manipulation in the draw.'' According to official sources, ``There had been several defects in way of the 1.77 lakh applications for the plots. And most of the defects were in the applications for the bigger residential plots, where the profits in a resale would be the largest. But now, most of the applications have been screened, and there are about 3,000 applications on which decisions have to be taken. `' Some of the applications in question, are those through which minors had got plots, despite being ineligible. There are also those through which all the members of particular families had won plots, or through which husband and wife couples got one plot each. Meanwhile, said IT sources, UPDESCO has still not furnished them copies of the software used in the countermanded draw. The New Okhla Industrial Development Authority (NOIDA) has also not furnished, to the department, the complete list of NOIDA employees and their kin who applied for plots and got allotments. An I-T official said: ``It is certain that there have been manipulations in the draw. How else could one person land up with as many as four plots. We are also checking how many property dealers, financiers or others filed multiple applications. We will also be checking the financial worthiness of those who got plots, to see how they would have paid for these. NOIDA has given us CDs of the applications in a format that will take a long time to screen.'' Interestingly, NOIDA, the Greater Noida Industrial Development Authority and the Ghaziabad Development Authority have not filed income-tax returns since it became mandatory for development authorities, in 1992. Through applications for the countermanded draw, the authority had netted at least Rs 70 crore in interest alone, said an I-T official.
