However what I could make out from your problem is that the builder committed certain deficiencies and shortcomings in the construction of your flat and took certain further advances from you to rectify the same. By way of security for these further advances, he executed a Sale Deed in respect of some other property in your favour. A Sale Deed has to be registered in order to be valid. If it is not registered, it is of no value. Are you sure that the document executed in your favour is a Sale Deed? Or is it an Agreement of Sale? What is the time of repayment specified therein? A great deal depends on the terms of the document that you have chosen to describe as a "Sale Deed." If it is an Agreement giving you an enforceable right over the property upon default being committed in repayment, then, you will have to check the terms of the document to ascertain the date of default.
You will have to take action within three years of the default, to enforce the right against the property. In the absence of further details from your end, I am unable to assist you any further in this regard. I advise you to see a lawyer and show to him or her all the documents in your custody so that you can take appropriate action. Since you say that more than three years have passed since the date of advance, I strongly urge you to act without any further delay.
