How Can An NRI Issue A Power of Attorney To Father For Purchase Of Land In NRI's Name?

Question: I am NRI working on H1b visa in the U.S. I am planning to purchase land in India, and want to issue Power of Attorney to my father who is in India to purchase land in my name. Is it valid to issue a `Power of Attorney' signed by the U.S. Notary in the U.S. format? Or, if this is not valid, how is the Power of Attorney issued?

To start with, i would like to say that the easiest way out is to issue a duly notarized Power of attorney (indian format available at with document writer) executed in presence of the US Lawyer shall suffice the requirement. Alternativly, It will be advisable to get a power of attorney at the consular section of the Indian embassy, this may cost you lesser and it would hold authenticity.

Further regarding payments, i would advice you that if you are tranferring funds from your US accounts then its ok. Otherwise if the funds are coming from your NRO account or NRE account, your father may require a mandate to operate such accounts. Forms for which are available at the Bank.

Kiran,
You will get the format from India.
If you want to finance from a bank, then the bank rep. can get it prepared from any court clerk. This is done on a Rs.100 non-judicial stamp paper
