A day after reports surfaced that the Haryana government had issued notices to call centres in Gurgaon asking them not to allow women employees to work on night shifts, the state government today clarified that the move was limited to just two companies -- Convergys and Saffron Global -- and that other call centres which already employ women at night need not worry.
Alleging the two companies "spread misinformation," state labour and employment secretary Romila Issar told ET that BPOs are normally exempted from Section 30 of the Punjab Shops and Commercial Establishments Act, 1958, which bars companies from employing women at night, but the exemption is subject to certain conditions. The two companies failed to honour those, and thus the notice, she said. On their part, the two companies refused to comment. The top brass of Saffron Global was unavailable for comment while an "official spokesperson" for Convergys, Sunanda Sanganeria, told ET that the company would be in a position to say something only after a meeting -- currently underway -- ended late at night. Before that, the only person who can speak on the issue was the company's communications head John Pratt, who is based in Cincinnati, US, she said. "I was shocked to read this. Mischievous elements in these two companies are circulating such foul canards against the government," said a fuming Ms Issar. As of now, an exemption from the 1958 Act has been given to 17 BPO centres in Haryana letting them employ women for night duty. This benefit is provided only on fulfilment of certain conditions like providing transport facilities, canteen facilities, policy framework against sexual harassment. "The checks by the government are organised regularly and those found wanting in these requirements are not extended any exemption. The exemption is not permanent and the organisation has to apply for it periodically," Ms Issar told ET. click full story for more
The exemption was available to both Convergys as well as Saffron Global. But during our last checks we found that some of their provisions were not satisfactory so notices were issued to them," said a deputy Labour Commissioner.
"Haryana government did conduct some checks about a month ago and they were satisfied with our arrangements and we have not received any notice that requires us to disallow women from working during night shifts," said officials of a leading research and analytical BPO firm operating from Gurgaon. The HR head of another call centre told ET: "Government is quiet clear in what it expects from the call centres and other organisations. Their main idea to ensure that the girl reaches her home in safety. There are clear policies on transport, canteen and a host of other issues. The only ambiguity is on the security issue. We still can't understand what constitutes security. Is one guard sufficient or are even 20 insufficient? But overall the directions are reasonably clear cut." Over 40,000 women are employed in various Gurgaon call centres. On their part, apex body of software exporters, Nasscom also said that there was no blanket ban from the government on women not being allowed to work at night in BPOs in Gurgaon. "Only some companies have been issued notices because as per government they do not meet certain conditions of Section of the concerned act. We cannot comment on the details of the involved companies, but NASSCOM member companies are the most responsible employers of women in the country. We are continuously engaged with the state government to comprehensively reform the labour laws to proactively focus on not only ensuring the best working conditions for all employees, but also to address the burning issue of accelerating the rate of job creation," a Nasscom official who didn't want to be quoted, told ET. source the economic times
