Haryana Govt Calls Prelaunches As Illegal - Intends Action Against Erring Developers

THE TOWN & country planning department has decided to take strong action against private developers involved in pre-launch sales of apartments and plots without acquiring the legitimate licence.

The Haryana government wants to do away with the prelaunch practice which according to the Haryana Urban Development Authority (HUDA) is a gross violation of the Urban Development Act.

Recently, Madhu Samita, the district town planner of Rewari, had issued notices to a number of developers and dealers involved in pre-launch sales. "This will check financiers and speculators from large-scale bookings of the properties which some of the developers have been offering for years," said HUDA administrator S.P. Gupta. "Selling of apartments and plots under the pre-launch category has no legal standing and is a clear cut violation of the Punjab Schedule Roads and Controlled Areas Restriction of Unregulated Development Act 1963 and Haryana Urban Area Development Act 1975. We have decided to put an end to this practice and have warned the developers first. We will book them under IPC if found guilty," Gupta added. Gupta has also asked the town planning departments of Gurgaon and Mahendragarh to take strong action against such developers and property dealers who are involved in pre-launch sales.

The Haryana CM has expressed serious concern on the matter.

The department will soon put up a legal notice in various newspapers warning developers against 'pre-launching' of their projects.

  • Some reputed developers also have decided to raise booking amount of their new apartments and plots from 10 to 20 per cent and put a rider restraining the new buyer from selling his property not before three installments. "The idea is to keep financiers and dealers away from booking large number of apartments and plots by paying tiny amount in the form of earnest money and continue trading the same multiple number of times," said Dharmendra Bhandari, director Bestech Group.
  • Ansal's Properties president N K Sehgal, who said that his com- pany never pre-launched any of their projects, welcomed the move. But he said, "People look- ing for viable properties deposit advance payments with us for fu- ture projects. We give preference to such people in allotment of apartments and plots. They are assured of properties in speci- fied time period and if we fail to do so, their money is returned."

i have booked an flat in kundli by giving 3 lak by post dated cheque and after knowing this my mind is changing that i should stop the payment for the booking. so just suggest me what should i do. give your suggestion early as my cheque date is 28th march. also tell me that bouncing of cheque will affect me or there is no problem in bouncing that.

Prelaunches vs advance registration (none / 0) (#6)

The news itself seems to be not researched well. The comment from Ansals is a paradox because most developers sell prelaunches as advance registrations only. Anybody who would have bought a prelaunch would know that the form that is signed is advance registration, the receipt rarely mentions the project, the price etc. So it is misleading.

Projects with licenses will definitely gain an edge than many others. Temporarily it may bing out a correction in the market with every tom, dick and harry coming out with prelaunches.

This will break/reduce the prelaunch compaign and it seems to me there will not be ads inciting people/investors/end users to go for prelaunches.

This might result into:
End use clients to be cautious and refrain from pre-launches.
The process might continue, but not with the same enthusiasm, as in the last 1 1/2 years.

Investors who would like to maintain nexus among themselves and builders (either directly or through brokers) will be able to get the plots(hopefuly). Investors might be able to get the prelaunch at a better bargain rate than the prevailing margins(between prelaunch and launch price)due to few takers in prelaunches

"I (the builder)want to get the money "FIRST" theory might fade away, leaving room for more money for builders and (few close investors)"

The strong builders might gain more than to lose (in prelaunches) as they might be able to dictate their terms(and price) due to diminished race (prelaunches) to get money out of the pockets of investors/end users etc.

The trend might be interesting, but all of the above could be too soon to conclude. And I hope to see more comments and criticism in the coming days

This would mean property developed by reputed builders and having LICENSE (TDI, Ansal, Omaxe etc.) will go up further in long run.

TDI has license from HUDA to acquire 900 acres of land.....so far it has 450-500 acres. This will reduce volatility, speculation and fly by night operators. Prices will stabilize.

Good move by Government.

But tdi has no license for kundli. no bank is giving loans for it. Prices will crash there 2!!
25-30% crash expected

Dallgiri can never be stopped no matter what rules are enforced in India, particularaly in Delhi and Gurgaon. You can not escape from these wasps. The reason is simple most of money in NCR has been earned by some sort of Dalla-giri no matter what field it is. Offcourse there are some people who are honest and have made money in real professions, but they are few.

prices shall crash:

1) 90% of thze properties aqre in the hand of speculators and not the end users.
2)Haryana govt. has declared and also UP govt.(very soon shall follow)that a unfinished proerty cannot be sold and can only be sold only if it is registered.

So this will lead to 2 registries and 2 stamp duty.
so in case of 1 crore flat minimum 20 lakh stamp duty.This will discourage speculators and only genuine end users shall buy.

So 90% of the investers shall back down.

There are abundance of 'HIGH value # flats available (empty) and thousands more shall be made available only in Gurgaon.

The problem will be multifolded by induction of many thousands of houses in noida, gerater noida, faridabad e.tc.

This is a starting of the end and the balloon will burst witha very hard and loud noise.

THE CREATION OF THESE ''EMPTY CITIES''
is based on the notion that India is shining. yes its true but the shine is not deep.

The amount of people cannot afford bunglows in delhi but can afford 70Laks-1 crore flats are not in thousands and 100 thosands.

SUPPLY has clearly exceeded the DEMAND.
