Can Builder make allotment without approved building plans?

Dear Friends,
I have booked a flat in gurgaon by 10% payment in pre-launch stage in early 2007. Its clearly stated in the booking form that next installment is due at the time of allotment of flat.

Now the builder has sent letters asking for the second installment to make provisional allotment while HUDA/DTCP has not yet given the approval of construction/layout plans.

I wish to know:
Can the builder legally give allotment of flat before approval of construction layout plans by HUDA/ Director,Country & town planning ?

Please forward your expert opinion.

On the face value, the builder is at fault.But it takes a collective effort to take on builders.Giving the builder & project name can help readers come together and take action.Almost every week there is a news on builders demanding money against agreements .. but never has there been a post that someone has confronted the builder.

Perhaps, you may show some guts yourself by giving your real name/telephone number. Do not ask others to do that you are not prepared to do.

I think He is asking builder name, not his own name.  If people will know builder name and project, only then they can suggest if they also faced similar problem, and the action they took to resolve it.

For that they don't need to know his name and number.

Yes, he is asking builder's name. But, read his question, he is asking if a builder can do that. What difference it makes what builder is involved?
The person asking the question does not want to  burn his bridges with the builder by giving builder's name. 'Rigidrock' should not be so noosy, and go to the extent of challanging the guts of the person asking the question. However, if he is  challanging a person he should give his own name/telephone number so anybody can go after him if he dispenses wrong advise. A lawyer is a professional giving advise. Others, who are not professionals have fiduciary duty to give correct advise.You are thinking allright, but you are not seeing through.

I have a booking at Vatika India next project and so far I do not have any bad experiences. I have pretty bad experience with BPTP which is due to their inability to execute and delays. No wonder now they have become 'B' rated builder after enjoying an 'A' reputation from some time according to industry sources.

I would like to setup a system in which I can aggregate customer experience figure to rate a builder without disclosing the customer's names. If you can collect this and make this information public then you will have some transparency.

It seems that the builder is fleecing you but you are too afraid to tell your builder/project name because the prices of this project might fall or whatever....

JUST NAME THE BUILDER/PROJECT..
You do not have to be legal expert to understand what builder is doing is unfair if not totally illegal...
