HC Asks Registrar To Allot Flats To Anjuman Housing Society Members In DwarkaBy Ni3, Section GN
Members of Anjuman Group Housing Co-operative Society in Dwarka would soon be allotted flats with the High Court directing the Registrar of Co-operative Societies to initiate the process of allotment. The court gave the go-ahead to the authorities while rejecting objections raised by former members of the society who had staked their claim for allotment of flat in the society.
A Division Bench of Justices Manmohan Sarin and SK Mishra also constituted a committee comprising retired Justice SK Mahajan and SK Jha for reviewing the recommendations made by the Registrar and Delhi Co-operative Societies (DCS) Committee and to verify the identity of the existing 120 members of the society. "The committee may in its discretion approve, modify, alter or remit any recommendations," the court said. The Bench rejected the objections made by the society's previous members that their resignations had been forged in 1992 and now DDA should allot flats to them instead of allotting it to the newly enrolled members of the society. "Members, who had either on their own volition chosen to resign or those who had been induced to resign and did not participate in the activities of the housing society, cannot be permitted now after a decade and half to turn around and seek allotment of flats," the bench observed. The present members of the society have paid Rs 17 lakh each for the flats and they are not party to any illegal practices of the society's previous managing committee. The former members had paid Rs 5,000 each. "The newly-enrolled members have been burdened with increased cost and had contributed to the funds of the society. In case these members are sought to be deprived of the fruits of their investments, it would be highly inequitable to them," the bench said.
Anjuman society was one of the group housing societies of Dwarka which came under the High Court's scrutiny after the multi-crore rupee CGHS scam was detected. However, the CBI after investigation found no criminality against the members of this society. Subsequently, the society has applied before DDA for allotment of flats to existing members through a draw of lots. The society had submitted all the required documents before the RCS office and also published in newspapers ads regarding the proposal for clearance of names of 120 members of the society for allotment of flats and invited objections. The original members who had resigned from the membership of the society had claimed that their resignations have been forged and now they are entitled for the flats. Source: The Pioneer 03/Sep/2008
